These Terms of Use ("Terms") govern your access to and use of the EyeAdvisor mobile application (the "App") provided by EyeAdvisor LLC ("EyeAdvisor," "we," "us"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
The App is provided to eye-care practices and their authorized staff as part of the EyeAdvisor service. If your practice has entered into a separate agreement with EyeAdvisor (for example, a service or business associate agreement), that agreement governs in the event of any conflict with these Terms.
Eligibility and Accounts
The App is intended for use by licensed eye-care professionals and authorized practice staff who are at least 18 years old. You must have a valid EyeAdvisor account, provided through your practice, to use the App.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised.
License to Use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your practice's internal, professional purposes. We reserve all rights not expressly granted.
Acceptable Use
You agree not to:
Use the App for any unlawful purpose or in violation of these Terms;
Access data or accounts that do not belong to your practice, or that you are not authorized to access;
Reverse engineer, decompile, copy, modify, or create derivative works of the App, except as permitted by law;
Interfere with or disrupt the integrity or performance of the App; or
Use the App to upload content you do not have the right to record, store, or share.
Your Responsibilities
You and your practice are solely responsible for:
Obtaining all consents and authorizations required to record, store, and process patient consultations, including any consent required under applicable recording, wiretapping, privacy, and health-information laws;
Ensuring your use of the App complies with HIPAA and all other applicable laws and professional obligations; and
The accuracy and appropriate use of any information captured, stored, or reviewed through the App.
